Dealing with difficult employees? Here's the next thing to consider

If you should refill the position in less than a year, redesign the job so a younger jobholder with a lower skill level is a better fit. In most lay offs, the risk is low because you have satisfactory documentation why the dismissal is occurring and most fired workers are unlikely to sue. Once you identify a difficult worker, your first step is to counsel the difficult individual. He or she can slow down production, cause other employees to become disgruntled, be a safety hazard, or even cause legal troubles. Discuss top-line points of the separation contract, if this is a condition for receiving extra severance. Having a Sample Notice of Disobedience Template Helps. As you may recall from Chapter 4, a high-risk dismissal is one where the employee will sue for improper dismissal (if you separate him) and he'll win in a court trial. In the first paragraph, the memorandum should obviously state that this employee is being fired.

Employee terminations are stressful for both the supervisor and the jobholder. Create a cover note to attach to the separation document which outlines main points of the meeting. With it, you'll make clear to the jobholder why he or she is losing their job. Begin the program by telling the jobholder why he or she will no longer be working for the company. If you don't layoff some people today, you'll bankrupt your small business and no one at the small company will have a job. I suggest the employee's supervisor does the layoff, unless you're also sacking this manager. But, be aware you now have 2 warnings in your personnel file and continued bad behavior will eventually lead to your dismissal from the company.". If the bad worker is conscientious but incapable of doing the job, then your offer of a position with lesser responsibilities may come as a relief to him.
